We’ve seen how the internet has been under attack from various directions, and we recognize that it’s time to make that stop. En Nyzeeländsk domare har beordrat amerikanska staten att lämna över kopior på all bevisning man har till den förvarande sidan, något som de har vägrat att göra. Detta är anmärkningsvärt då det är svårt att förvara sig om man inte vet vad motståndarsidan kommer att använda för bevisning. USA har hävdat att man inte har rätt att se bevisning i ett utlämningsärende, något den Nzeeländske domaren nu har sagt nej till och man har 21 dagar på sig att lämna över alla dokument man har i ärendet.

Much of today’s ruling looks into procedural issues, but Judge Harvey also makes some interesting remarks on the way the U.S. is handling this case. He notes that if the U.S. has its way the extradition process would be merely “administrative”, as opposed to “judicial”. This would interfere with the rights of the accused, who according to Judge Harvey should have the right to review the evidence so they can argue against it.

“In my view there must be fairness and the hearing and balance must be struck, otherwise the record of case becomes dominant virtually to the exclusion of everything else and places the extradition process in danger of becoming an administrative one rather than judicial,” the verdict reads.

The Judge further grants disclosure of evidence related to all the criminal charges, and notes that the allegations of the U.S. Government are rather complex. For example, the authorities are applying civil copyright concepts in a criminal context. Furthermore, he notes that the copyright infringement changes are the cornerstone, in the sense that the money laundering, wire fraud and racketeering charges are all based on the alleged copyright infringements.

“There is a complex factual matrix and justiciable issues are complicated by the fact that the United States is attempting to utilize concepts from the civil copyright context as a basis for the application of criminal copyright liability which necessitates a consideration of principles such as the dual use of technology or what they described as significant non-infringing use,” Judge Harvey writes.

“The existence of criminal copyright charges is a keystone to providing the unlawful conduct element of the racketeering, money laundering and wire fraud charges.”

Kommer VPN att bli olagligt?

Across the world initiatives are appearing with an aim to increase Internet monitoring. In the U.S. file-sharers will soon be monitored and reported on behalf of the MPAA and RIAA, and in the UK there are plans to monitor and store all Internet communications. Countering this increased surveillance people are turning en masse to VPN services to ensure their privacy. This begs the question; how long before VPNs become illegal?

I sin iver att slå tillbaka mot den olagliga fildelningen kommer man förmodligen att titta på om det går att göra VPN olagligt.

Problemet med detta är att det är samma teknik som till exempel företag använder för att kryptera sin interna datatrafik mellan olika kontor över det publika internet. Det medför att man kan använda billigare kopplingar till det publika internet i stället för att behöva hyra dedikerade fasta förmindelser mellan sina olika kontor.

Det är lätt att se orimligheten i detta…

Back in February, we wrote up a warning to “the internet as we know it” as the UN’s International Telecommunications Union (ITU) was looking to take over control of the internet, mainly at the behest of countries like Russia and China who were seeking a “more controlled” internet, rather than the very open internet we have today. The major concern was that almost no one in the US seemed to care about this or be paying much attention to it. The February call to action may not have done much, but the situation has certainly changed in the last couple of weeks.

Internets frihet är ständigt under attack. Ibland är det nöjesindustrin som vill censurera, övervaka och stänga av. Ibland är det kriget mot terrorismen som motiverar övervakning och kontroll. Sedan har vi den förbannade barnporren, länder som vill stoppa spel på nätet, moralpanik och brottslighet i största allmänhet. Den som vill inskränka nätets frihet kan alltid hitta en ursäkt.

Läckta dokument avslöjar oroväckande planer inför FN-organet Internationella Teleunionens konferens i december. Vince Cerf, en av de människor som på riktigt kan kallas en av internets skapare säger att “det öppna internet har aldrig varit i större fara än det är just nu”.

Eli Dourado på George Mason University i USA har publicerat de läckta ITU-dokumenten och säger “These proposals show that many ITU member states want to use international agreements to regulate the Internet by crowding out bottom-up institutions, imposing charges for international communication, and controlling the content that consumers can access online.”

Dewt handlar om att det finns stater som inte är nöjda med hur internet styrs och hur man kan styra vad som publiceras på internet.

[…Bland annat vill] Kina att alla nationer skall ges den slutliga kontrollen över infrastrukturen för information och kommunikation inom sina respektive länder – i syfte att på ett mer effektivt sätt kunna övervaka det som sker på nätet. Detta riskerar naturligtvis även att hacka sönder internet med elektroniska gränser.

Ryssarna och vissa arabländer vill att FN skall kunna reglera innehåll på nätet. Och Ryssland vill ta betalt för gränsöverskridande internettrafik. (Även vissa europeiska telekommunikationsbolag är inne på den linjen.)

Dessutom är en del kritiska till ICANN som man anser USA har för mycket kontroll över.

Om dessa idéer och planer blir verklighet, då kommer vi inte bara att få ett hårt övervakat, censurerat och kontrollerat internet. Det världsomspännande nätet kommer då att få murar – och på många håll att i princip förvandlas till nationella, slutna intranät.

Det kommer att göra nätet som vi känner det i dag direkt dysfunktionellt. Den dynamik och de synergieffekter som fria, världsomspännande strömmar av information givit oss kommer då att strypas.

Detta får inte ske. Ett fritt, öppet och globalt internet är ett av mänsklighetens verkligt stora steg framåt. Det vore en dumhet av episka proportioner att inte tillvarata dess möjligheter fullt ut.

Läckta TPP-dokument visar att USA vill ge enorma befogenheter till privata företag

Tidigare har raportering runt TPP mest handlat om IP-kapitlet (intelecual property) som har visat på att man återigen, precis som med ACTA, med hemliga förhandlingar försöker anta ett handelsavtal som får långtgående konsekvenser och bland annat inskränker våra fri- och rättigheter på internet.

Although the TPP has been branded a “trade” agreement, the leaked text of the pact’s Investment Chapter shows that the TPP would:

  • Limit how U.S. federal and state officials could regulate foreign firms operating within U.S. boundaries, with requirements to provide them greater rights than domestic firms;
  • Extend the incentives for U.S. firms to offshore investment and jobs to lower-wage countries;
  • Establish a two-track legal system that gives foreign firms new rights to skirt U.S. courts and laws, directly sue the U.S. government before foreign tribunals and demand compensation for financial, health, environmental, land use and other laws they claim undermine their TPP privileges; and
  • Allow foreign firms to demand compensation for the costs of complying with U.S. financial or environmental regulations that apply equally to domestic and foreign firms.

Obama Trade Document Leaked, Revealing New Corporate Powers And Broken Campaign Promises

A critical document from President Barack Obama’s free trade negotiations with eight Pacific nations was leaked online early Wednesday morning, revealing that the administration intends to bestow radical new political powers upon multinational corporations, contradicting prior promises.

The leaked document has been posted on the website of Citizens Trade Campaign, a long-time critic of the administration’s trade objectives. The new leak follows substantial controversy surrounding the secrecy of the talks, in which some members of Congress have complained they are not being given the same access to trade documents that corporate officials receive.

Dear Members of the United States Senate Committee on Finance:

We write as legal academics with expertise in Constitutional, international, and intellectual property law to encourage you to exercise your Constitutional responsibility to ensure that the Anti-Counterfeiting Trade Agreement (ACTA) is submitted to the Senate for approval as an Article II treaty, or to the Congress as an ex post Congressional-Executive Agreement. It is our studied opinion that the administration has failed to identify ex ante authorization of ACTA by Congress, and that these are thus the only Constitutional bases for U.S. entry into ACTA. It is clear that other ACTA negotiating parties – including the EU, Australia, Mexico, and others—are treating ACTA as a binding international agreement requiring legislative ratification under constitutional standards similar to our own. We encourage you to demand the same element of public process in our own country.

De som skriver under det öppna brevet har stora problem med hur processen för ACTA har skötts i USA och hävdar att det är kongressen som måste besluta om detta och att det inte är ett vanligt handelsavtal. Den exekutiva delen av staten (presidenten) har enligt dem inte mandat att förhandla fram och skriva under ett så omfattande avtal.

Remedying this state of affairs is uniquely within Congress’s province. Congress, and specifically the Senate, as the Constitutionally recognized chamber with responsibilities for the approval of treaties, should secure from the Administration a public pledge to send ACTA to the Senate as a treaty, or to the Congress as an ex post Congressional-Executive Agreement. Absent a pledge to this effect, we encourage the Committee to hold hearings and to pass legislation that would prevent the United States from binding itself to ACTA without express Congressional consent.

Storskalig attack mot bittorrent trafiken?

En stor mängd av trafiken verkar vara felaktig, något som kan användas för att störa riktig trafik.

De har även lite funderingar på om denna aktivitet är laglig:

Anomaly through it’s nature (large share in daily network traffic) produces visible disruption in IT systems and large amount of our false-positive high-level alerts is a good proof. In terms of Polish law, European Convention on Cybercrime and U.S. Codes (and probably many other sources of domestic law) legality of process producing the anomaly is questionable.

Den allmämna misstanken är att denna trafik, om den är medveten, kan härledas tillbaka till underhållningsindustrin, som står att vinna mest på om bittorrenttrafiken störs. Det som är intressant att fundera på är om man bör använda olagliga metoder för att, som privat organisation, bekämpa olaglig, och till viss del, laglig verksamhet…
